Can I legally sell my home without a real estate agent?

Broker Transactional Insight

Yes. Completely legal in all 50 states. No law requires you to hire a real estate agent to sell your own home. This is your property, and you have every right to sell it yourself.

What you'll hear from the real estate industry is that FSBO is "risky" or "complicated" or that sellers "always leave money on the table." Some of that concern is legitimate if you go in underprepared. The legal right to sell your own home, though, is not in question. Never has been.

What a listing agent actually does, from someone who has been one for over 23 years: they handle marketing and exposure, pricing guidance, contract negotiation, and transaction coordination through closing. That's the job. None of those tasks require a license when you're doing them on your own behalf. The license requirement applies to someone performing those services for another person for compensation. That distinction matters.

What you're actually giving up when you go FSBO isn't legal protection. It's someone else's time, experience, and market relationships. You're taking on a job that most homeowners have never done before. That's the real challenge, not the legal question.

Where you do need a professional: The purchase contract. In most states, that's a legally binding document with real financial and legal consequences. You don't need to understand it the way a real estate attorney does, but you need someone qualified reviewing it before you sign. In some states that's an attorney. In others, a title company handles closing and can flag obvious issues. Either way, don't skip that step. The cost of a real estate attorney reviewing a contract is a few hundred dollars. The cost of signing something you didn't understand can be far more.

Everything else, pricing, photography, marketing, showing the home, fielding offers, negotiating, you can do. It takes preparation and organization, but none of it is beyond a motivated seller who goes in with the right information. Thousands of homeowners do this successfully every year.

The question isn't whether you can do it. The question is whether you're positioned to do it well. That starts with being honest about your timeline, your market, and what you're willing to take on. If those things are aligned, FSBO is a completely legitimate path, and the commission you keep is real money.
