Do I need a real estate attorney to sell my home by owner?

Whether you need a real estate attorney for your FSBO sale depends partly on your state and partly on the complexity of your transaction. In some states, attorney involvement in real estate closings is legally required. In others, title companies handle closings routinely without attorneys. Even where it's not legally required, there are specific situations where having an attorney review documents is simply the right call, and the cost of that review is almost always worth it.

Several states, including Georgia, New York, South Carolina, and Massachusetts, require a licensed real estate attorney to conduct or oversee the closing. If you're in one of those states, the question isn't whether to hire an attorney but which one and how to build that into your process from the beginning. Your title company can tell you what's required in your state.

Even in states where attorneys aren't required, I'd strongly recommend having one review the purchase and sale contract before you ratify it. Standard real estate contracts used in your state are drafted by real estate associations to be balanced, but they contain clauses with significant implications that aren't intuitive from a plain reading. Default remedies, specific performance clauses, how contingency deadlines work, what constitutes proper notice, what happens if a buyer's lender falls through two days before closing. These are not simple, and the cost of misunderstanding them is high.

A real estate attorney reviewing a purchase contract will look at the terms and timelines for each contingency, the earnest money provisions and default remedies, the closing date and possession terms, any seller representations and warranties, and any addenda or special conditions. For a standard residential transaction, this review might take one to two hours of an attorney's time, typically a few hundred dollars. Compare that to the potential cost of a contract dispute and the calculation isn't hard.

Always involve an attorney when: Title issues arise, meaning a lien, a boundary dispute, an estate sale with multiple heirs, a property that's been in a trust, or any situation where the chain of title is complicated. Any situation where a buyer threatens legal action or where you're receiving legal correspondence. Don't try to navigate those situations with a title company alone.

The title company is a neutral facilitator, not your advocate. They review the title, handle escrow, and coordinate settlement. For a straightforward sale with a qualified buyer, a title company closing is often sufficient. For anything complex, don't rely on the title company alone.
